RoHS currently applies to eight of the ten WEEE categories:

  1. Large household appliances
  2. Small household appliances
  3. IT and telecommunications equipment
  4. Consumer equipment
  5. Lighting Equipment
  6. Electrical and electronic tools
  7. Toys, leisure and sports equipment
  8. Automatic Dispensers

Two categories of Electrical and Electronic equipment in WEEE

  1. Medical Devices
  2. Monitoring and Control Equipment

are temporarily excluded from RoHS requirements.   Under the RoHS Directive, the EU Commission was required, by February 13 2005, to Commission  present proposals for including in the scope of this Directive equipment which falls under categories 8 and 9.  While the Commission has not yet made a proposal, their consultants, recently prepared a report (.pdf) recommending:

  • Bring Categories 8 & 9 into the cope of RoHS, starting in 2012, with exceptions for in-vitro diagnostic equipment until 2016, industrial test and measurement equipment until 2016 or 2018, and active implanted medical devices until 2020 or beyond
  • Include a temporary exemption for lead in solder until 2012
  • Approve 20 recommended exemptions
  • Provide a permanent exclusion from scope for lead, mercury and cadmium used in sensors, detectors and electrodes used Category 8 and 9 equipment
  • Clarify the definitions of Categories 8 and 9
